Understanding the process

Family Court cases are managed through applications, hearings, evidence and orders. Each hearing should have a defined purpose.

  1. Identify the application.

    Find the form or application that started the issue and note what orders are requested.

  2. Identify the current stage.

    Common stages include first hearing, safeguarding enquiries, directions, dispute resolution and final hearing. Your notice or order should identify the next event.

  3. Read every order as a task list.

    Highlight deadlines, documents required and responsibilities assigned to each person or organisation.

  4. Keep the legal question separate from the emotional history.

    Ask: what must the court decide at the next hearing, and what evidence assists that decision?
